DMCA Policy

PietroPinto.Cloud respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines our procedures for handling copyright infringement claims.

1. Overview

In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), PietroPinto.Cloud will respond expeditiously to claims of copyright infringement committed using our services. We are committed to protecting the rights of copyright owners while ensuring that our users' legitimate use of our services is not unduly restricted.

2. Reporting Copyright Infringement

If you believe that content hosted on or transmitted through our services infringes your copyright, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

2.1 Required Information

Your DMCA takedown notice must include:

  1. Physical or Electronic Signature: A signature (physical or electronic) of a person authorized to act on behalf of the copyright owner
  2. Identification of Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered, a representative list of such works
  3. Identification of Infringing Material: A description of the material that you claim is infringing and information sufficient to permit us to locate the material, including:
    • The URL(s) where the infringing material is located
    • Specific file names or identifiers
    • Any other information that will help us locate the material
  4. Contact Information: Your contact information, including:
    • Your name, address, telephone number, and email address
  5. Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Important: Knowingly making a false claim of copyright infringement may result in liability for damages, including costs and attorneys' fees. Please ensure that your claim is legitimate before submitting a DMCA notice.

2.2 How to Submit a DMCA Notice

DMCA takedown notices must be sent to our Designated Copyright Agent:

Please include all required information listed in section 2.1. Incomplete notices may not be processed.

2.3 Sample DMCA Notice Format

I request that you remove or disable access to the infringing material.

3. Our Response to DMCA Notices

Upon receipt of a valid DMCA takedown notice, we will:

  1. Review the Notice: We will review the notice to ensure it contains all required information and appears to be valid
  2. Remove or Disable Access: If the notice is valid, we will remove or disable access to the allegedly infringing material expeditiously
  3. Notify the User: We will notify the account holder whose content was removed, providing them with a copy of the DMCA notice and information about their right to file a counter-notification
  4. Document the Action: We will maintain records of all DMCA notices and actions taken

We typically respond to valid DMCA notices within 1-3 business days. However, response times may vary depending on the complexity of the case and the completeness of the notice.

4. Counter-Notification

If you believe that your content was removed in error, you may submit a counter-notification to our Designated Copyright Agent.

4.1 Counter-Notification Requirements

Your counter-notification must include:

  1. Physical or Electronic Signature: Your signature (physical or electronic)
  2. Identification of Removed Material: A description of the material that was removed and the location where it appeared before removal
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Consent to Jurisdiction: Your consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the United States, to the jurisdiction of the United States District Court for the Southern District of New York)
  5. Contact Information: Your name, address, telephone number, and email address
  6. Statement of Consent: A statement that you consent to service of process from the person who provided the original DMCA notice or their agent

4.2 How to Submit a Counter-Notification

Counter-notifications must be sent to:

  • Email: dmca@pietropinto.cloud
  • Subject Line: "DMCA Counter-Notification"

4.3 What Happens After a Counter-Notification

Upon receipt of a valid counter-notification:

  1. We will forward the counter-notification to the original complainant
  2. We will inform them that we may restore the material in 10 business days
  3. If the original complainant does not file a court action seeking a court order against you within 10 business days, we will restore the removed material
  4. If a court action is filed, we will not restore the material until the matter is resolved

Warning: Filing a false counter-notification may result in liability for damages. Only file a counter-notification if you have a legitimate basis to believe the material was removed in error.

5. Repeat Infringers

In accordance with the DMCA, PietroPinto.Cloud maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We consider a "repeat infringer" to be a user who has been the subject of two or more valid DMCA takedown notices.

Our process for handling repeat infringers:

  • First valid DMCA notice: Content removed, user notified
  • Second valid DMCA notice: Content removed, user warned about repeat infringement policy
  • Third or subsequent valid DMCA notice: Account may be terminated at our discretion

We reserve the right to terminate accounts immediately in cases of egregious or willful copyright infringement.

6. False Claims

Knowingly submitting a false DMCA takedown notice or counter-notification may result in:

  • Liability for damages, including costs and attorneys' fees
  • Potential criminal penalties for perjury
  • Termination of your account with our services

We take false claims seriously and may pursue legal action against individuals who abuse the DMCA process.

7. Restoration of Removed Content

Content may be restored in the following circumstances:

  • Upon receipt of a valid counter-notification and expiration of the 10-business-day waiting period without a court action
  • If the original DMCA notice is withdrawn by the complainant
  • If a court determines that the material does not infringe copyright
  • At our discretion if we determine the original notice was invalid or submitted in bad faith

8. Third-Party Content

PietroPinto.Cloud provides hosting and cloud infrastructure services. We do not actively monitor content uploaded by our users. As a service provider, we act as an intermediary and respond to valid DMCA notices in accordance with the law.

We are not responsible for the content uploaded by our users, but we will take appropriate action when notified of copyright infringement in accordance with this policy.

9. Fair Use and Other Defenses

Users may have legitimate defenses to copyright infringement claims, including:

  • Fair use under 17 U.S.C. § 107
  • Ownership of the copyright
  • License or authorization to use the material
  • Material is in the public domain

If you believe your use of material is protected, you may submit a counter-notification as described in section 4.
