Important: If you do not agree to these Terms, you must not use our services. Your use of our services constitutes acceptance of these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using any services provided by PietroPinto.Cloud, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. Description of Services
PietroPinto.Cloud provides cloud hosting services, including but not limited to:
- Web hosting services
- Virtual Private Server (VPS) hosting
- Email hosting services
- AI coding and development services
- Domain registration and management (if applicable)
- Related technical support and services
We reserve the right to modify, suspend, or discontinue any service at any time with or without notice.
3. Account Registration and Security
3.1 Account Creation
To use our services, you must:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Be at least 18 years old or have parental consent
- Maintain the security of your account credentials
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using strong passwords and enabling two-factor authentication when available
4. Acceptable Use Policy
You agree not to use our services for any unlawful or prohibited purpose. Prohibited activities include, but are not limited to:
4.1 Illegal Activities
- Violating any applicable laws or regulations
- Infringing on intellectual property rights
- Distributing malware, viruses, or harmful code
- Engaging in fraud, phishing, or identity theft
4.2 Prohibited Content
- Child pornography or exploitation material
- Copyrighted material without authorization
- Defamatory, libelous, or slanderous content
- Content that promotes violence, hate, or discrimination
- Spam, unsolicited bulk emails, or phishing attempts
- Content that violates privacy rights
4.3 Resource Abuse
- Excessive CPU, memory, or bandwidth usage that affects other users
- Running resource-intensive applications without appropriate plan
- Attempting to circumvent service limitations
- Distributed denial-of-service (DDoS) attacks
4.4 System Security
- Unauthorized access attempts to our systems or other users' accounts
- Scanning or probing network vulnerabilities
- Interfering with service operations or security measures
- Violating any security or authentication measures
5. Payment Terms
5.1 Pricing and Billing
- Service fees are billed in advance on a monthly, quarterly, or annual basis
- Prices are subject to change with 30 days' notice
- All fees are non-refundable unless otherwise stated
- Additional services (installation, licenses, etc.) are billed separately
- Taxes, if applicable, are your responsibility
5.2 Payment Methods
We accept various payment methods including credit cards, debit cards, and other payment processors. You agree to provide valid payment information and authorize us to charge your payment method for all fees.
5.3 Late Payments
If payment is not received by the due date:
- Services may be suspended until payment is received
- A late fee may be applied
- We reserve the right to terminate services after 30 days of non-payment
- Data may be deleted after termination
5.4 Refunds
Refund policies vary by service type:
- Web Hosting: 30-day money-back guarantee for new accounts (setup fees non-refundable)
- VPS Services: No refunds after service activation
- Domain Registrations: Non-refundable per domain registrar policies
- Add-on Services: Non-refundable unless service is not delivered
Refund requests must be submitted within the applicable refund period. Setup fees, installation fees, and license fees are non-refundable.
6. Service Level Agreement (SLA)
We strive to maintain 99.9% uptime for our services. However:
- Scheduled maintenance will be announced in advance when possible
- We are not liable for downtime caused by factors beyond our control
- Service credits may be available for extended outages (contact support for details)
- No SLA applies to free or trial services
7. Data and Backups
7.1 Your Responsibility
You are solely responsible for:
- Maintaining your own backups of all data
- Ensuring data integrity and security
- Complying with data protection regulations
- Protecting sensitive information
7.2 Our Backup Services
While we may provide backup services:
- Backups are provided as a convenience and are not guaranteed
- We are not responsible for backup failures or data loss
- Backup retention periods vary by service plan
- You should maintain independent backups
8. Intellectual Property
8.1 Our Intellectual Property
All services, software, trademarks, and content provided by PietroPinto.Cloud are our property or licensed to us. You may not:
- Copy, modify, or distribute our proprietary materials
- Reverse engineer or decompile our software
- Use our trademarks without permission
- Remove copyright or proprietary notices
8.2 Your Content
You retain ownership of content you upload to our services. By using our services, you grant us a license to:
- Store, process, and transmit your content as necessary to provide services
- Use your content for backup and disaster recovery purposes
- Comply with legal obligations
9. Third-Party Services and Licenses
Our services may include or integrate with third-party software, services, or licenses:
- cPanel: Licensed separately, fees apply
- Windows Server: Licensed separately, fees apply
- Other Software: Additional licenses may be required and billed separately
- Installation Services: Billed separately based on complexity
You are responsible for compliance with third-party license terms. We are not responsible for third-party service availability or performance.
10. Service Modifications and Termination
10.1 Modifications
We reserve the right to:
- Modify, suspend, or discontinue services at any time
- Change service features, pricing, or terms
- Perform maintenance that may cause temporary service interruptions
10.2 Termination by You
You may cancel your services at any time by:
- Submitting a cancellation request through your account
- Contacting our support team
- Services will continue until the end of the current billing period
- No refunds for unused portions of the billing period
10.3 Termination by Us
We may terminate or suspend your services immediately if:
- You violate these Terms or our Acceptable Use Policy
- You fail to pay fees when due
- You engage in illegal or harmful activities
- Required by law or court order
- You breach any material term of these Terms
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our services are provided "as is" and "as available"
- We make no warranties, express or implied, regarding service availability, performance, or results
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid for services in the 12 months preceding the claim
- We are not responsible for data loss, business interruption, or lost profits
12. Indemnification
You agree to indemnify, defend, and hold harmless PietroPinto.Cloud, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any law or rights of third parties
- Content you upload or transmit through our services
13. Dispute Resolution

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect. The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original.
17. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and PietroPinto.Cloud regarding the use of our services.
